When a company buys a car for a director to use, the key tax question is whether the car is used for the company’s business or for the director’s personal benefit. The tax treatment can be very different depending on the facts, the company’s policy, and the supporting documents.
From a corporate income tax perspective, if the car is genuinely used for business purposes, the company may record depreciation and related expenses such as fuel, insurance, repair, and maintenance, subject to tax rules. However, if the car is mainly used for the director’s personal benefit and the company cannot prove business use, the expenses may be challenged as personal expenses or expenses not exclusively for the business. The Revenue Department explains that personal expenses or expenses not incurred exclusively for business purposes may be treated as non-deductible expenses under Section 65 ter.
For passenger cars or vehicles with not more than 10 seats, the depreciation rule is especially important. The Revenue Department states that depreciation for passenger cars and vehicles with not more than 10 seats is deductible only on the cost portion not exceeding Baht 1 million, unless the vehicle is used directly in a car rental business and not used in other activities. Therefore, if the company buys a car for Baht 3 million, the tax depreciation is generally limited based on Baht 1 million, not the full purchase price.
VAT is another important issue. Input VAT on the purchase, hire-purchase, lease, or transfer of passenger cars and vehicles with not more than 10 seats is generally non-creditable. The same applies to input VAT on goods or services related to such vehicles. In practice, this means the company should not automatically claim input VAT from the car purchase, lease, fuel, repair, or related expenses. However, certain non-creditable input VAT may be treated as a deductible expense for corporate income tax purposes, subject to the relevant rules.
If the director is allowed to use the car for personal purposes, the company should also consider the director’s personal income tax. The personal use of a company car may be viewed as a benefit provided to the director. The Revenue Department has applied the principle that benefits paid by a company for a director may be treated as assessable income under Section 40(1), depending on the facts. Therefore, the company should consider whether the value of personal use should be included in the director’s taxable income and subject to withholding tax.
The company should also keep clear evidence of business use. Useful documents include a company car policy, board approval, assignment of the car to the director, travel logs, fuel records, repair invoices, insurance documents, GPS or mileage records, and explanations of business purpose. In a Revenue Department ruling on car-related reimbursements, the Department emphasized the need for clear evidence such as travel records, distance, vehicle registration details, receipts, and proof that the expenses were incurred for work duties.
When the company later sells the car, the tax treatment should also be reviewed. For tax purposes, the deductible remaining cost of a passenger car may be limited to the portion calculated from the cost not exceeding Baht 1 million. The Revenue Department has ruled that the excess cost above the tax-deductible limit cannot be deducted when calculating net profit on disposal.
In summary, buying a car for a director is possible, but the company must be careful. The key issues are whether the car is used for business, whether the expenses are deductible, whether input VAT is creditable, whether the director receives a taxable benefit, and whether proper documents are maintained. The safest approach is to have a written car policy, clear approval, business-use evidence, and proper tax treatment from the beginning.
