Foreign nationals wishing to work legally in Thailand generally need appropriate immigration permission and authorization to work. For most foreign directors, managers, professionals, and skilled employees hired by Thai companies, this involves obtaining a Non-Immigrant B Visa and a Work Permit from the Department of Employment, Ministry of Labour. However, visa permission and work authorization are separate matters. A Non-Immigrant B Visa does not automatically authorize employment, and a Work Permit does not independently extend the foreign national's permitted stay in Thailand.

Thailand introduced the nationwide e-WorkPermit system on 13 October 2025. In 2026, eligible foreign professionals and their employers can submit applications, upload supporting documents, track approval status, and arrange permit collection through the Department of Employment's official website at https://eworkpermit.doe.go.th/. The system also provides access to applications for work permit renewals and employment notifications. Applicants may still need to attend an authorized service center for identity verification and permit collection.

The basic eligibility requirements depend on the foreign national's immigration status, intended occupation, and employer. Under the ordinary skilled-worker route, the applicant must generally hold appropriate permission to stay, normally a Non-Immigrant Visa rather than tourist or transit status. A genuine employer must support the application, and the proposed occupation must not be prohibited to foreign nationals. The applicant should possess qualifications and experience appropriate for the position. Regulated professions may additionally require authorization from the relevant professional body.

For ordinary employment-based extensions of stay, Immigration Bureau rules generally require the employer to have at least THB 2 million of paid-up registered capital, a ratio of four permanent Thai employees for each foreign employee, and evidence of genuine business operations. The foreign employee must also satisfy a minimum monthly income requirement based on nationality.

Supporting evidence may include audited financial statements, corporate income tax returns, payroll withholding tax filings, and employment records. Certain businesses and immigration categories benefit from specific exemptions or modified requirements. These are particularly important criteria for extending permission to stay for employment and should not be treated as universal statutory conditions for every Work Permit application.

For example, a Thai trading company employing one foreign manager under the ordinary employment extension route should normally assess whether it has at least THB 2 million in paid-up capital, four qualifying Thai employees, and sufficient evidence of operating activities. If the company wants to support two foreign employees under the ordinary framework, the corresponding capital and staffing expectations may effectively increase to THB 4 million and eight Thai employees, subject to applicable rules and exemptions. Merely registering capital without genuine operations or qualifying employees may not be sufficient.

The application normally begins with the Thai employer preparing a legitimate job offer and supporting corporate documents. If the foreign employee is outside Thailand, the employer may submit an advance work authorization application through the Department of Employment using the relevant procedure, currently associated with Form BT.32, historically referred to in visa guidance as WP.3.

The approval documentation may then support the employee's application for a Non-Immigrant B Visa through a Thai embassy or consulate. Thai visa applications can be initiated through the official e-Visa website at https://www.thaievisa.go.th/, subject to the requirements of the responsible diplomatic mission.
After entering Thailand with the appropriate immigration status, the employee applies for the Work Permit, generally through Form BT.25 under Section 59 for the ordinary skilled-worker route.

Applications are submitted through https://eworkpermit.doe.go.th/. Employers and employees register their information, upload the required documents, complete the application, and pay the applicable fees. Once approved, the applicant follows the system instructions for identity verification and permit collection. Work should not commence before the necessary authorization has been obtained, unless a specific legal exception applies.

The foreign employee's supporting documents commonly include a passport, valid visa or evidence of permitted stay, employment contract or employment certification, educational qualifications, employment experience, photographs, and a medical certificate meeting the applicable requirements. Where the occupation is regulated, an appropriate professional license or authorization may also be required. The employer normally prepares its company registration documents, shareholder information, business description, relevant tax or Social Security filings, and evidence supporting the proposed employment. Additional documents may be required depending on the company's activities, the applicant's nationality, and the application category.

The Department of Employment's published fee schedule identifies a THB 100 application fee and Work Permit fees depending on the approved duration. The indicated permit fees are THB 750 for up to three months, THB 1,500 for more than three and up to six months, and THB 3,000 for more than six and up to twelve months. Additional fees apply for longer periods. These are government permit fees and do not include visa charges, professional service fees, medical examinations, or document preparation costs.

Where should applicants register? The principal channel for ordinary Work Permit applications in 2026 is the Department of Employment's e-WorkPermit website. Foreigners working in Bangkok may obtain assistance through the relevant Bangkok Employment Office, while applications elsewhere are supported by Provincial Employment Offices and authorized Work Permit Service Centers. Questions about the system may be directed to the Department of Employment hotline 1694 or Ministry of Labour hotline 1506, extension 2. Employers should confirm the service center applicable to their business and work location before arranging attendance.

Companies promoted by the Thailand Board of Investment (BOI) may follow a different route for approved foreign executives, experts, and skilled personnel. The employer must obtain the necessary approvals for the foreign position and employee under its investment promotion privileges. BOI applications are handled through the Single Window for Visa and Work Permit system, accessible through the BOI's official online services. Qualifying applicants may use the Thailand Investment and Expat Services Center (TIESC) at One Bangkok. BOI-related permissions are subject to the promoted project's approval conditions rather than automatically following every ordinary employer requirement.

Foreign nationals should also check whether their intended work is legally restricted. Certain occupations, including accounting and auditing services, are subject to restrictions on foreign workers, with limited exceptions under applicable laws and international arrangements. A foreign manager overseeing a business is not necessarily performing the same legally classified activities as a practicing accountant or auditor. However, job descriptions must reflect actual duties, and professional restrictions cannot be avoided merely by using a different job title.

After receiving a Work Permit, the employee must continue to maintain valid immigration permission. A standard initial Non-Immigrant B entry commonly allows a stay of up to 90 days, while a qualifying employment-based extension may allow a longer period, commonly up to one year at a time. The employee and employer must monitor both expiration dates, comply with the applicable employment notification requirements, and seek amendments or new authorization when changes to employment require them. A Work Permit and permission to remain in Thailand should therefore be managed as two coordinated but distinct compliance obligations.

Ultimately, obtaining a Work Permit in Thailand in 2026 involves more than registering an employee online. Employers must establish genuine employment, verify the proposed occupation, prepare appropriate corporate and employee documents, and comply with both labour and immigration requirements. The e-WorkPermit system has simplified submission procedures, but it has not eliminated the substantive eligibility rules. For business owners, accountants, and HR professionals, the most effective approach is to confirm the correct immigration category and employer qualifications before submitting the application, thereby reducing the risk of rejection, unnecessary costs, or unauthorized employment.

Single Window for Visa and Work Permit ของ BOI และหน่วยงานที่เกี่ยวข้อง ผู้ที่เข้าเกณฑ์อาจรับบริการผ่านศูนย์ Thailand Investment and Expat Services Center หรือ TIESC ที่โครงการ One Bangkok ทั้งนี้ สิทธิและเงื่อนไขการจ้างงานขึ้นอยู่กับประเภทกิจการและการอนุมัติของ BOI ไม่จำเป็นต้องเหมือนหลักเกณฑ์ของนายจ้างทั่วไปทุกประการ
